Terms & Conditions for Accommodation Contract

(Scope of Application)
Article 1.
1. Contract for Accommodation and related agreements to be entered into between This Hotel and the Guest to be accommodated
    shall be subject to these Terms and Conditions.  Any particulars not provided for herein shall be governed by laws and
    regulations and/or generally accepted practices.
2. In the case where The Hotel has entered into a special contract with the Guest, insofar as such special contract does not violate
    laws and regulations and generally accepted practices, notwithstanding the preceding paragraph, said special contract shall take
    precedence over the provisions of these Terms and Conditions.

(Application for Accommodation Contracts)
Article 2.
1. A Guest who intends to apply for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars: 
(1) Full name of the Guest(s);
(2) Date of accommodation and estimated time of arrival;
(3) Accommodation Charges (based in principle on the Basic Accommodation Charges listed in the Attached Table No. 1); 
(4)?????? ?

  ‡AName and contact information of the person responsible for 
  payment to The Hotel for all appropriate charges;
(5) Other particulars deemed necessary by The Hotel

2. In the case where the Guest requests, during his /her stay, an extension of the accommodation beyond the date(s) in 
   subparagraph (2) of the preceding clause, it shall be regarded as an application for a new Accommodation Contract at the time
   such request is made.

(Conclusion of Accommodation Contract, etc.)
Article 3.
1. A Contract for Accommodation shall be deemed to have been concluded when The Hotel has duly accepted the application as
   stipulated in the preceding Article.
2. When a Contract for Accommodation has been concluded in accordance with the provisions of the preceding paragraph, the
   Guest is requested to pay an accommodation deposit set by The Hotel within the limits of the Basic Accommodation Charges
   covering the Guest's entire period of stay by the date specified by The Hotel.
3. The deposit shall be first applied to the Total Accommodation Charges to be paid by the Guest, then secondly to the cancellation
   charges and compensation in this order on the occurrence of any event to which Article 6 or 17 applies, and the remainder, if any, 
   shall be refunded at the time of the payment of the Accommodation Charges as stated in Article 12.
4. When the Guest has failed to pay the deposit by the date required as stipulated in Paragraph 2, the Hotel shall treat the
   Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel
   when the period of payment of the deposit is specified.
5. When a customer applies for Accommodation Contract using PEANUTS HOTEL Internet Reservation Service (hereinafter called
   gThe Serviceh) managed by the Hotel, notwithstanding the provision of Paragraph 1 of this Article, the Contract for Accommodation
   shall be deemed to be concluded upon issuance of reservation confirmation email.
6. When a customer applies for Accommodation Contract using The Service, the accommodation charges shall be paid in advance
   by credit card on The Service, or by a method specified by the Hotel. Other than the charges informed at the time of
   Accommodation Contract establishment, any additional charges incurred during the stay shall be paid at the Hotel.

(Special Contracts Requiring No Accommodation Deposit)
Article 4.
1.?Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no
   Accommodation Deposit after the Contract has been concluded as stipulated in the same Paragraph.
2. In the case where The Hotel has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article
   and /or has not specified the date of payment of the deposit at the time when an application for an Accommodation Contract has
   been accepted, the Hotel shall treat such cases as having accepted a special contract prescribed in the preceding paragraph.

(Refusal of Accommodation Contracts)
Article 5
1. The Hotel may not accept the conclusion of an Accommodation Contract under any of the following cases:
(1) When the application for accommodation does not conform to the provisions of these Terms and Conditions;
(2) When the Hotel is fully booked and no room is available;
(3) When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that would contravene laws or
   act against the public order or good morals in regard to his/her accommodation;
(4) When any one of the following conditions applies to the person seeking accommodations:
 ‡@Designated organized crime group and a member of a designated organized crime group or related thereto, or other antisocial
    forces (hereinafter collectively called "Organized Crime Group") under the Act on Prevention of Unjust Acts by Organized Crime
    Group Members (Act No. 77 of 1991);
 ‡ACorporate entity or other forms of organization whose business activities are controlled by an Organized Crime Group or a
    member thereof;
 ‡BCorporate entity having a member of an Organized Crime Group serving on its board of directors or a member thereof.
(5) When the Guest seeking accommodation can be clearly identified as carrying an infectious disease;
(6) When the Hotel is requested to assume an unreasonable burden to accommodate the Guest;
(7) When the Hotel is unable to provide accommodations due to natural calamities, malfunction of facilities and/or other unavoidable
   causes;
(8) When the person requesting Hotel accommodation could cause annoyance to other guests due to intoxication, or when the
   person is behaving in such a manner as to be an annoyance to other guests;
(9) When the provisions of Article 10 of Hyogo Prefectural Hotel and Ryokan Management Law Enforcement Ordinance are
   applicable;
(10) When the Guest has violated these gTerms and Conditionsh (including when the Hotel has deemed there is a risk that the Guest
   Guest will violate them);
(11) When the Guest uses the Hotel for the purposes not acceptable to the Hotel.

(Right to Cancel Accommodation Contracts by the Guest)
Article 6
1. The Guest is entitled to cancel Accommodation Contracts by notifying The Hotel.
2. In the case where the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Hotel is
   not liable (except in the case when the Hotel has requested payment of the deposit during the specified period as prescribed in
   Paragraph 2 of Article 3 and the Guest has cancelled before payment), the Guest shall pay cancellation charges as listed in the
   Attached Table No.2.  However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, 
   the same shall apply only when the Guest is informed of the obligation of payment of cancellation charges in case of cancellation
   by the Guest.
3. In the case where the Guest does not appear by twelve ofclock midnight of the accommodation date without an advance notice
   (or 2 hours after the expected time of arrival if the Hotel has been notified beforehand), the Hotel may regard the Accommodation
   Contract as being cancelled by the Guest and proceed to take the necessary procedures.
4. When a customer has applied for Accommodation Contract using The Service, he/she must declare his/her intention concerning
   Paragraph 1 of this Article using The Service of by telephoning to the Hotel.

(Right to Cancel Accommodation Contract by the Hotel)
Article 7
1. The Hotel may cancel the Accommodation Contract under any of following cases:
(1) When the Guest is deemed to be liable due to conduct or is found to have conducted himself /herself in a manner that will
   contravene the laws or act against the public order and good morals in regard to his/her accommodation;
(2) When any one of the following conditions applies to the person applying for the Accommodation Contract or related contracts or
   to the person who will use the Hotel:
 ‡@A member of specified organized crime group or related thereto, or of other antisocial forces
 ‡ACorporate entity or other forms of organization whose business activities are controlled by an Organized Crime Group or a
    member thereof;
 ‡BCorporate entity having a member of an Organized Crime Group serving on its board of directors or a member thereof.
(3) When the Guest can be clearly detected as a carrying an infectious disease;
(4) When the Guest has used violence, threat, extortion in making demands of the hotel employees, or has requested the Hotel to
   assume an unreasonable burden, or when the Guest is deemed to have committed the same act before.
(5) When the Hotel is unable to provide accommodation due to natural calamities and/or other unavoidable causes;
(6) When the person requesting Hotel accommodation could cause annoyance to other guests due to intoxication, or when the
   person is behaving in such a manner as to be an annoyance to other guests;
(7) When the provisions of Article 10 of Hyogo Prefectural Hotel and Ryokan Management Law Enforcement Ordinance are
   applicable;
(8) When the Guest does not observe prohibited actions such as smoking in bed, mischief relative to the firefighting equipment and
   other prohibitions of the Rules & Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid
   the causing of fires).
(9) When the Guest has violated these gTerms and Conditions,h and/or has violated the Hotelfs Rules & Regulations set forth in the
   Article 10 of Terms and Conditions. (including when the Hotel has deemed there is a risk that the Guest will violate them);
(10) When the Guest uses the Hotel for the purposes not acceptable to the Hotel.

2. In the case when the Hotel has cancelled the Accommodation Contract in accordance with the preceding Paragraph, 
   The Hotel shall not charge the Guest for any of the services which he/she has not received. 

 (Registration)
Article 8.
1. A Guest shall register the following particulars form at the front desk of the Hotel on the day of accommodation:
 (1)Name and surname, age, gender, address and occupation of the Guest(s);
 (2) For a foreign national, nationality, passport number, port and date of entry in Japan
 (3) If a foreign national does not have a residential address in Japan, in addition to information listed in the preceding paragraph, 
   a copy of his/her passport;
 (4) Date and estimated time of departure;
 (5) Name(s) and surname(s) of the accompanying person(s);
 (6) Other particulars deemed necessary by the Hotel

2. In the case where the Guest intends to pay his /her Accommodation Charges prescribed in Article 12 by any means other than
   Japanese currency, such as travelerfs checks, coupons or credit cards, such means of payment shall be shown in advance
   at the time of registration prescribed in the preceding Paragraph when registering

(Occupancy Hours of Guest Rooms)
Article 9.
1. A Guest is entitled to occupy the contracted guest room of the Hotel from 3:00 p.m. to 11:00 a.m. of the following day. 
   However, in the case when the Guest is accommodated a number of consecutive days, the Guest may occupy the room
   all day long, expect on the days of arrival and departure. 
   In addition, although a room is to be generally available for occupancy from 3:00 p.m. a Guest may be requested to wait beyond
   3:00 p.m. before occupying the assigned room due to maintenance or some other unavoidable reasons.
2. The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the room
   beyond the time prescribed in the same Paragraph. In this case, extra charges shall be paid as follows:
 (1)Extended use up to one hour of the day of departure: 2,000 yen
 (2)Extended use up to two hours of the day of departure: 4,000 yen
 (3)Extended use of two hours or more of the day of departure: 100% of the room charge

(Observance of the Regulations)
Article 10.
1. While in the Hotel, the Guest shall observe the Rules and Regulations established by the Hotel.

(Information of the facilities)
Article 11.
1. The Hotelfs Rules and Regulations and information and business hours of the main facilities are posted at each location, 
   and are also available at the front desk.
2. The business hours and services of the facilities are subject to change without any prior notice in an event of unavoidable situation.

(Payment of Accommodation Charges)
Article 12.
1. The breakdown of the Accommodation Charges, etc. that the Guest shall pay is as listed in the attached Table No. 1.
2. Accommodation Charges, etc. as stated in the preceding paragraph shall be paid at the front desk at the time of the Guest's
   arrival or upon request by the Hotel in Japanese currency, or by other means as deemed acceptable by the Hotel; such as
   traveler's checks, coupons or credit cards.
3. Once accommodation facilities have been made available by the Hotel, the Accommodation Charges shall be paid even if the
   Guest voluntarily chooses not to utilize the facilities.

(Liabilities of the Hotel)
Article 13.
1. The Hotel shall compensate the Guest for damages if the Hotel has caused such damage to the Guest in the fulfillment or the
   non-fulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in case where such
   damage has been caused due to reasons for which the Hotel is not liable.
2. The Hotel has a Written Notice of Finding from Fire Services. Nevertheless, 
   The Hotel is covered by Hotel Liability Insurance in order to deal with unexpected fires and/or other disasters.

(Handling When Unable to Provide Contract Rooms)
Article 14.
1. The Hotel shall, when unable to provide contracted room(s) to a Guest, with the consent of the Guest, arrange an alternate
   accommodation with the same or as practicably the same conditions elsewhere for the Guest.
2. Notwithstanding the provisions of the preceding Paragraph, in the event of the Hotel not being able to provide an alternate
   arrangement of another accommodation to a Guest, the Hotel shall pay the Guest a compensation fee equivalent to the
   accommodation charges and said compensation fee shall be applied to compensation for damages the Guest incurs thereby. 
   However, if the Hotel cannot provide an alternate accommodation on account of causes for which the Hotel is not liable, the Hotel
   shall not compensate the Guest.

(Handling of Deposited Articles)
Article 15.
1. The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused to goods deposited at the
   front desk by the Guest except in cases of force majeure.  The Hotel does not keep cash or valuables for Guests at the front desk.
2. The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused to goods the Guest had
   brought into the Hotel, if such damages were caused intentionally or negligently by the Hotel. 
   However, in the event of the Guest failing to disclose the type and value of the goods in advance, except when the damages are
   arising on account of intentional or gross negligence on the part of the Hotel, the Hotel shall compensate up to a maximum total
   amount of 100,000 yen.

(Custody of Baggage and/or Belongings of the Guest)
Article 16.
1. When the baggage of the Guest is brought into the Hotel before his /her arrival, The Hotel shall assume responsibility for safe
   keeping of the said baggage only in a case when such request has been accepted by the Hotel prior to the delivery of the baggage. 
   The baggage shall be handed over to the Guest at the front desk at the time of his/her check-in.
2.?When the Guest checks out, leaving his/her baggage or belongings behind, the Hotel will try to identify the owner, and contact
   him/her to ask for instructions. lf no instructions from the owner are received or if the owner is not identifiable, the Hotel will keep
   baggage for seven days including the day when they were found, and then will bring them to the nearest police station as lost
   articles. However, the food and drink shall be disposed on the same day.
3. The Hotelfs liability in regard to the custody of the Guestfs baggage and belongings in the case of the preceding two paragraphs
   shall be assumed in accordance with the provisions of Paragraph 1, in the case of Paragraph 1, and with the provisions of
   Paragraph 2, in the case of Paragraph 2.

(Liability of the Guest)
Article 17
1. In the event of a Guest causing damages to the Hotel intentionally or as a result of his/her negligence, the Guest shall compensate
   the Hotel for such damages incurred by the Hotel.

(Disclaimer)
Article 18
1. The Hotel may temporarily suspend The Service without prior notice in the following cases:
 a. To carry out server maintenance, repair, improvement, etc.
 b. When failures occur in the system and/or with the hardware needed to provide The Service.
 c. When it is necessary to temporarily suspend the system in order to renovate or upgrade the computer program, etc.
 d. When failures occur in the internet network, thus falling into a communication disabled state.
 e. In any other unavoidable circumstances

2. If a user of The Service causes trouble(s) or damage(s) to others by using The Service, the parties concerned are responsible for
   resolving them, and no liability shall be incurred by the Hotel.
3. No liability shall be incurred by the Hotel even if a user of The Service was unable to use The Service due to the circumstances
   described in Paragraph 1 of this Article or due to certain communication state which caused inconvenience(s) and/or damage(s)
   to him/her.

(Changes to The Terms and Conditions)
Article 19
1. The Hotel may change The Terms and Conditions without prior notice to the users of The Service. When a user uses The Service
   after the changes to The Terms and Conditions have been made, the Hotel shall regard that the user accepted the terms after the
   changes.

(Agreement of Jurisdiction)
Article 20
1. In the event of a dispute that cannot be resolved by discussion between the parties concerned, the court having jurisdiction over
   the location of the Hotel shall have exclusive jurisdiction and the dispute shall be settled in accordance with Japanese laws and
   regulations.

In the event of enactment of a revision of tax law, revised law shall become applicable thereafter.
The Basic accommodation charges are in accordance with the tariff shown at the front desk and the guest room.

¦ The percentages signify the rate of the cancellation charges to the Basic Accommodation charge.
¦ When the number of days contracted is shortened, a cancellation charge for the first day shall be paid by the Guest,

(Public Announcement)
Article 21
1. The Hotel has installed fire detectors at various locations in compliance with the Fire Service Act.  In an event of the system
   detector detecting fire or generation of smoke for other reasons, a message may be broadcasted over the in-house PA system. 
   The Hotel shall not be liable for any damages a Guest may incur due to broadcasting of such PA message.
